Hey Team,
I noticed the “Skip Registration” button on the download page, and something about it got me thinking about GDPR compliance. I’m not a lawyer or anything (IANAL), but I thought it might be worth mentioning just in case.
Here’s the gist:
- Fairness and Transparency (GDPR Article 5(1)(a)): The GDPR says processing data has to be fair and transparent. If the button’s design could confuse or mislead people, it might raise some questions here.
- Consent (Article 7): Consent needs to be clear, informed, and freely given. If the design nudges people into something they didn’t mean to do, it might not meet that standard.
For reference, there’s been some regulatory heat around this kind of thing recently:
- The privacy group NOYB filed complaints about cookie banners using “dark patterns,” and it kicked off investigations. Here’s a link to their work: NOYB Dark Patterns Case.
- The EDPB also has guidance on avoiding these kinds of issues: EDPB Guidelines on Dark Patterns.
Just wanted to flag this—it might be nothing, but better safe than sorry, right? Thanks for reading, and let me know if I can clarify anything!
Cheers,
Shteryan Nikolaev
